PARKING BAN

No person owning, operating or controlling a motor vehicle, shall park, or cause to be parked, said motor vehicle on any street or road within the Town of Lincoln so as to obstruct the plowing of snow from November 15th through April 15th, both inclusive; provided, however, that the foregoing shall not apply to motor vehicles owned, operated or controlled by persons attending the sick or injured, or attending church services.

*Please note, that while the Parking Ban refers to vehicles not getting towed while folks are at church services, the reference has to do with the fact that the church has regular services and people need not worry about getting towed while in attendance. Likewise, if there is a public event at Burnham, the school, etc., the same would apply. Generally, the ban is to keep folks from parking in the way of the plows. You're probably safe if parked on the edge of the road at a public event; however, if you're visiting friends, or you're out hunting or skiing, etc, park well off the road so as not to interfere with the plows.


PRIVATE SNOW REMOVAL POLICY

The purpose of this policy is to protect the Town roads with in the Town of Lincoln and prevent snow removal practice that results in snow encroaching on the highway right-of-way, thereby creating a safety hazard for the traveling public. Vermont law, per 19 VSA # 1105, 111(b), prohibits the placing of obstructions within highways and highway rights-of-way. Violation of this law can result in a fine of up to $1000.00 as well as personal liability for the costs of repairing any damage, and for reasonable attorney’s fees.

In 1997, the Vermont legislature enacted 23 VSA # 11126a, which prohibits depositing snow onto or across highways. “No person, other than an employee in the performance of his or her official duties or other person authorized by …. the Selectboard shall plow or otherwise deposit snow onto the traveled way, shoulder, or sidewalk of a state highway or a class 1, 2, or 3 town highway”. This law is enforceable by any law enforcement officer per 23 VSA # 1013.

Please Note: The Lincoln Gap Road has been closed for the winter. Please don't open the gate and travel through because it is more convenient for you than going around. If you choose to ignore the closed signs and travel over the Gap, understand that you are doing so at your own risk. If you get into trouble with snow or ice, the Town Road Crew will not come up to sand, salt or plow so you can get down. You will need to make your own arrangements.
